Archer Aviation, a key player in the air taxi industry, has taken legal action against rival Vertical Aerospace, accusing them of patent infringement in their air taxi designs. The dispute revolves around Archer’s ‘Midnight’ aircraft design, which they claim Vertical Aerospace copied for their ‘Valo’ vehicle. This accusation led Archer Aviation to file a complaint in the US District Court Eastern District of Texas to address the alleged infringement.
According to the complaint, ‘Vertical has knowingly, willfully, and in reckless disregard leveraged and exploited the substantial goodwill and reputation associated with Archer’s patented designs.’ Archer contends that Vertical Aerospace’s actions have given them an unfair advantage by replicating patented features that Archer invested significant time and resources in developing.
Both aircraft, Archer’s Midnight and Vertical’s Valo, are four-passenger electric aircraft with tilt-rotor propellers for vertical takeoff and landing. They share similarities in cruising speed and range, highlighting the contentious similarities in their designs.
Eric Lentell, Archer’s chief strategy and legal officer, stated, ‘Vertical’s Valo aircraft mimics many of Midnight’s most distinctive design features, indicating an attempt to imitate a leader in the sector.’ This legal action underscores the competitive landscape and the importance of protecting intellectual property in the rapidly evolving air taxi market.
